With consideration in order to transform waste as a source of energy and improve the quality of the environment, and to increase the role of new renewable energy-based electricity, the government considers it necessary to accelerate the development of Waste-Based Power Generation in some cities.

On that consideration, President Joko Widodo on February 13, 2016 has signed the Presidential Regulation No. 18 of 2016 on the Acceleration of Development of Waste-Based Power Plant in DKI Jakarta Province, Tangerang City, Bandung City, Semarang City, Surakarta City, Surabaya City and Makassar City .

Through the Presidential Regulation, the government affirmed the acceleration of the construction of Waste Based Electricity Generator (PLTSa) 2016-2018 through the utilization of waste that became the affairs of the Provincial Government of DKI Jakarta, Tangerang City, Bandung City, Semarang City, Surakarta City, Surabaya City and Makassar City.

"In the case of the amount of waste that has become the affairs of Surakarta City has not reached the required economies of scale for power plants in Surakarta, it is done in cooperation with Karanganyar regency, Sukoharjo regency, Boyolali district, Wonogiri regency, Sragen regency and Klaten regency called Regional Surakarta , "Reads Article 2 paragraph (2) of the Presidential Regulation.

In order to accelerate the development of this PLTSa, according to the Presidential Decree, the Governor of DKI Jakarta, Tangerang Mayor, Mayor of Bandung, Mayor of Semarang, Mayor of Surakarta, Mayor of Surabaya and Mayor of Makassar appoints a regional-owned enterprise or appoints private business entity to carry out the development of PLTSa.

Regional-owned enterprises or private business entities appointed as intended, may cooperate with other business entities, and / or District / Municipal Government adjacent to the construction site of PLTSa.

"Regional-owned enterprises or private business entities appointed as intended to act as Municipal Waste Management and Developer PLTSa," read Article 4 paragraph (2) of the Presidential Regulation. In the framework of the assignment of a regional-owned enterprise or the appointment of a private enterprise, according to this Presidential Decree, the Regional Government: a. Ensure the availability of waste with a minimum capacity of 1,000 tons per day;
b. Ensure the availability of PLTSa development sites in Provincial Spatial Plans and District / City Spatial Plans;
c. Prepare studies on the development services of PLTSa covering legal, institutional, funding, socio-cultural, and technological aspects.

The Presidential Regulation also stipulates that local government-assigned business entities or appointed private business entities are granted the ease of acceleration of direct construction investment permits, where activities to commence construction can be carried out simultaneously in parallel with the maintenance of building permits and environmental permits.

Purchase of Electricity According to this Presidential Regulation, the ESDM Minister assigns PT PLN (Persero) to purchase electric power from regionally-owned business entities assigned or appointed private business entities. "The assignment of PT PLN (Persero) as intended includes: a. Appointment for purchase of electricity by PT PLN (Persero); and b. Approval of the purchase price of electricity by PT PLN (Persero). Furthermore, the proceeds from the sale of electricity to PT PLN (Persero) are the rights of the assigned regional business entity or the designated private business entity.

This Presidential Regulation stipulates that PT PLN (Persero) must sign a power purchase agreement within a period of 35 (thirty five) working days after the assignment of the assigned regional business entity or private enterprise appointed as the PLTSa Developer. The funding source for PLTSa development comes from the State Budget (APBN), Regional Revenue and Expenditure Budget (APBD), and other legal sources in accordance with the provisions of laws and regulations.

While the provisions concerning the cost of waste processing are regulated by the Minister of Home Affairs Regulation after coordinating with the Minister of Finance and related ministers, in accordance with the provisions of legislation.

Article 14 of this Presidential Regulation stipulates that the development of PLTSa prioritizes the use of domestic products, which are carried out in accordance with the provisions of legislation in the field of accelerated development of electricity infrastructure.
